These Terms of Service and this Privacy Policy govern your use of LocalFixx — the website, mobile experience, and underlying services that connect homeowners and businesses ("customers") with independent local service professionals ("pros") and general contractors, across every trade we support. By creating an account, submitting a request, accepting a quote, or otherwise using LocalFixx, you agree to both documents below.
LocalFixx is a marketplace, not a staffing agency or a construction company. Every pro and general contractor on the platform is an independent business, not a LocalFixx employee or agent. These terms are a contract between you and LocalFixx for your use of the platform itself — they don't make LocalFixx a party to the actual service agreement between a customer and a pro. That agreement is formed directly between the two of them the moment a customer accepts a quote, and it's binding on both sides: the customer is obligated to pay the accepted amount for the completed work, and the pro is obligated to complete the work as described in the quote. Sections 4 and 5 below cover what that means for each side in more detail.
LocalFixx matches customers with vetted local pros across trades like plumbing, electrical, HVAC, cleaning, carpentry, and more, dispatches requests, hosts quoting and messaging, processes payment through Stripe, and gives pros tools to run their business (mileage, expenses, tax reports, fleet and inventory tracking, staff scheduling). Separately, general contractors can post multi-trade project scopes that subcontractors bid on. LocalFixx does not perform the work itself, does not guarantee the outcome of any job, and is not a licensed contractor. Every pro and general contractor is an independent business that contracts directly with the customer for the work performed — LocalFixx doesn't direct or control the manner or means of any job, and nothing in these terms creates an employment, agency, partnership, or joint-venture relationship between LocalFixx and any pro, general contractor, or customer.
You must be at least 18 years old and able to form a binding contract to create an account. You're responsible for the accuracy of the information on your account and for anything that happens under it, including from a staff member you've added to a pro account. Keep your login credentials to yourself — tell us right away at support@localfixx.com if you think your account has been compromised.
When you post a request, matched pros can send you a quote. Accepting a quote creates a job and forms a binding service agreement directly between you and that pro: you're agreeing to pay the quoted amount (plus any service fee shown at checkout, and any change order you separately approve) once the work is completed, the same as accepting a written estimate from any outside contractor would obligate you to pay for the finished job. Accepting a quote also authorizes payment through Stripe for that amount. Ballpark price ranges shown before you post a request are estimates, not binding quotes — only a pro's actual quote is binding once you accept it. If something goes wrong with a job, use the in-app dispute tool first (see Section 9) before pursuing anything outside the platform. Inviting any service professional into your home or business — whether found through LocalFixx or otherwise — carries inherent risk that no verification process can fully eliminate; using LocalFixx to arrange a job means accepting that risk, the same as hiring any outside professional.
A quote you send is a binding offer. When a customer accepts it, that acceptance forms a service agreement directly between you and the customer — separate from these terms — and you're agreeing to complete the described work for the quoted price, or the current total if the customer later approves a change order. As a pro, you represent that you hold any license, insurance, and permits your trade and jurisdiction require, and that the information you submit for verification — including license numbers, certificates of insurance, and background-check consent — is accurate. LocalFixx may verify this information directly with issuing authorities and background-check providers, and may suspend or remove your account if a credential lapses, fails verification, or a background check turns up a disqualifying result. You're responsible for your own tax reporting, insurance, and compliance with labor law for any staff you employ — the tools LocalFixx provides (mileage, expense, and tax-summary reports) are organizational aids, not tax or legal advice.
If you log a job you completed outside LocalFixx (a cash job, a walk-in customer) using the "outside job" tool, you're representing that the job actually happened and that the amount you entered is accurate — this feeds directly into your own tax reports, so misreporting it is on you, not LocalFixx.
General contractors can post project scopes for subcontractor bidding. A GC is responsible for verifying that any subcontractor they select is properly licensed and insured for the scope awarded, independent of any verification LocalFixx has already performed on that pro's account. Once a scope is published, its terms are locked to keep bidding fair to every subcontractor who bid on it — cancel and repost a new scope if the terms need to change materially.
Payments are processed by Stripe; LocalFixx never stores your full card number. When a customer pays for a job, LocalFixx holds the funds briefly before releasing the pro's share, less LocalFixx's commission — the commission rate depends on the pro's subscription tier (Free, Pro, or Elite) and is shown before checkout. Pro and Elite subscriptions renew automatically at the interval you choose until canceled; you can cancel anytime from your account's billing portal, effective at the end of the current billing period. Refunds for a specific job are handled through the dispute process in Section 9, not as a standalone refund request.
Using LocalFixx means sharing content with us beyond plain text — before/after job photos, photos of a request or project you post, your profile photo or business logo, and written reviews or descriptions. Here's how that content is handled:
If a job doesn't go as expected, open a dispute from the job in question — this notifies both sides and, where relevant, an admin reviewer, and can result in a full or partial refund, a redo, or the dispute being closed with no action. Both parties agree to use this process in good faith before pursuing a chargeback, a complaint elsewhere, or legal action over a specific job.
You agree not to:
LocalFixx is provided "as is." We work to vet pros through license lookups, insurance verification, and background checks, but we don't guarantee the quality, timeliness, or outcome of any job, and we don't guarantee that every listed credential remains current between our checks. Cost estimates, tax summaries, and similar in-app figures are informational, not professional advice — confirm anything tax- or legal-related with your own CPA or attorney. Separately, the LocalFixx website and app themselves are provided on an "as is" and "as available" basis — except where the law doesn't allow it, we disclaim all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't promise the platform will be uninterrupted, error-free, or secure against every possible failure.
To the fullest extent the law allows, LocalFixx isn't liable for indirect, incidental, or consequential damages arising from your use of the platform or from a job performed by a pro or general contractor, and our total liability for any claim is limited to the greater of the commission LocalFixx actually collected on the job in question, or $100. This limit doesn't apply to LocalFixx's own gross negligence, willful misconduct, or fraud, or to any liability that can't legally be limited or excluded — nothing in this section disclaims liability the law doesn't let us disclaim.
You agree to defend and indemnify LocalFixx against claims arising from your violation of these terms, your content, or a job you performed or requested — this doesn't excuse LocalFixx from its own obligations under these terms.
You can close your account at any time. We can suspend or terminate an account that violates these terms, fails verification, or poses a risk to other members — where reasonably possible, we'll tell you why.
We may update these terms as LocalFixx's features change. We'll update the date at the top of this page; material changes will be flagged in-app or by email before they take effect. Continuing to use LocalFixx after a change takes effect means you accept the update.
These terms are governed by California law, and any dispute not resolved through Section 9's process belongs in the state or federal courts located in California, except as Section 17 provides otherwise.
Section 9 covers disputes between members over a specific job. This section is different — it covers a dispute between you and LocalFixx itself, for example over these terms, your account, fees, or how the platform operated.
You and LocalFixx agree to resolve any such dispute through binding, individual arbitration rather than in court, except that either of us may bring an individual claim in small claims court, and either of us may seek injunctive relief in court to stop misuse of our intellectual property or unauthorized access to the platform. Arbitration is conducted under the American Arbitration Association's rules for consumer-related disputes, and the arbitrator — not a court — decides any dispute about whether a particular claim belongs in arbitration.
Both of us agree to bring claims only as individuals, not as a plaintiff or class member in any purported class, collective, or representative proceeding. If any part of this class-action waiver is found unenforceable for a particular claim, that claim — and only that claim — proceeds in court instead of arbitration, and the rest of this section stays in effect.
You can opt out of this arbitration agreement entirely, keeping the right to sue in court instead, by emailing support@localfixx.com within 30 days of first creating your account, with your name and a clear statement that you're opting out of arbitration. Opting out doesn't affect any other part of these terms.
If a court or arbitrator finds a particular part of these terms unenforceable, the rest of these terms remain in effect, and the unenforceable part is read narrowly to accomplish its original intent as closely as the law allows.
